Veteran Masonry Inc. – Official Contract Terms, Deposits, and Refund Policy

VETERAN MASONRY INC. TERMS AND CONDITIONS (EFFECTIVE 06/2025)

These Terms and Conditions govern all proposals, contracts, and masonry services provided by Veteran Masonry Inc. For each project, the contract version in effect on the date of your acceptance, signature, or payment will apply.
1. FORMATION OF AGREEMENT This Agreement is legally binding upon Customer’s written or electronic acceptance of the attached quote, payment of any deposit, or issuance of a purchase order referencing this Agreement. Ohio law recognizes acceptance via signature, payment, or electronic confirmation.
2. WARRANTY OF WORKMANSHIP & MATERIALS All work is performed in accordance with Ohio Revised Code § 1345.02. Materials will match the description in your proposal. New construction carries a five (5) year limited warranty. No warranty is provided for temporary repairs, patchwork, or damage caused by third-party materials, neglect, or external conditions. Warranty claims must be made in writing. Incidental or consequential damages are excluded except as required by Ohio law.
3. RIGHT TO CANCEL (OHIO HOME SOLICITATION SALES ACT) If this contract was solicited at your residence or business, you may cancel within three (3) business days of signing, per Ohio Revised Code § 1345.21 et seq., by written notice to Veteran Masonry Inc., 850 Euclid Ave, Ste 819 #4465, Cleveland, OH 44114 or [email protected]. Exceptions: The right to cancel does not apply if custom/special materials have been ordered or if emergency work was requested and begun within the three-day window.
4. PAYMENT TERMS, NON-REFUNDABLE DEPOSIT & REFUND POLICY A non-refundable deposit is required to secure scheduling and initiate procurement for your project. All credit card payments are subject to a 3% processing fee. Remaining balance is due upon completion unless phased billing is specified. Late balances (over seven (7) days) accrue 1.5% interest per month (18% annual). Customer is responsible for all collection costs, including attorney fees.
Refund Policy: Deposits are strictly non-refundable once materials have been ordered or labor has been scheduled, except as specifically required by law. No refunds of deposits or other payments will be issued in the event of customer cancellation after the three-day statutory window, or after work has begun or materials have been ordered. If Veteran Masonry Inc. agrees in writing to issue a refund, it will be processed within thirty (30) calendar days.
When Refunds Are Legally Required (Rare Cases): Refunds may only be required by Ohio or federal law if Veteran Masonry Inc. commits proven fraud, intentional misrepresentation, or criminal acts, or is completely unable to perform solely due to its own fault. In all other cases—including customer change of mind, delays beyond our control, or third-party issues—no refunds are due. Ohio law permits non-refundable deposits if disclosed and reasonable.
5. PROPERTY DAMAGE & INSURANCE Customer is responsible for maintaining adequate property insurance. Veteran Masonry Inc. is not responsible for pre-existing damage, site obstructions, hidden utilities, or unknown subsurface conditions unless specifically included in the proposal.
6. CHANGES & ADDITIONAL WORK All requested changes or additions must be described in writing and signed by both parties. Additional work is billed separately. No extras will be performed without a written change order.
7. SCHEDULING, DELAYS & FORCE MAJEURE Scheduling is subject to weather, material delivery, labor, and inspections. Veteran Masonry Inc. is not liable for delays outside its direct control and will reschedule in good faith. In cases of force majeure (acts of God, government actions, pandemics, labor strikes, material shortages, etc.), schedules may be extended or the contract terminated without liability or refund.
8. NON-DISPARAGEMENT Customer agrees not to post, publish, or encourage negative, defamatory, or disparaging statements about Veteran Masonry Inc., its staff, or its work. This survives completion or termination of the contract.
9. LIMITATION OF LIABILITY Total liability for any claim is limited to the lesser of $500 or 20% of the contract price. No liability for indirect, consequential, incidental, or third-party damages.
10. GOVERNING LAW & VENUE This contract is governed by the laws of the State of Ohio. Any disputes must be resolved exclusively in courts or arbitration in Cuyahoga County, Ohio.
11. ATTORNEY FEES The prevailing party in any action to enforce this contract may recover reasonable attorney fees and costs.
12. SEVERABILITY If any provision of this contract is held invalid, the remainder will continue in force.
13. ENTIRE AGREEMENT & AMENDMENTS This contract and the attached proposal constitute the entire agreement. Amendments must be in writing and signed by both parties.
14. ARBITRATION AGREEMENT (Ohio R.C. § 2711) All disputes shall be resolved by binding arbitration in Cuyahoga County, Ohio under the Ohio Uniform Arbitration Act. Each party bears its own costs, unless otherwise determined by the arbitrator.
15. CHANGES TO TERMS & POSTED CONTRACT VERSION Veteran Masonry Inc. reserves the right to update, modify, or amend these contract terms at any time. The most current version is always available at https://www.veteranmasonry.com/terms. For each project, the version in effect as of the date of Customer’s acceptance, signature, or payment will govern the work for that job, unless otherwise agreed in writing. Updates will not retroactively affect work already contracted or in progress, unless expressly agreed to in writing by both parties. By contracting with Veteran Masonry Inc., Customer acknowledges review and acceptance of the terms in effect as of the date of their acceptance, as published on the company’s website or attached to the proposal.
